Terms of Use

These Terms of Use (“Terms”) govern the use of the customer portal (“Portal”) provided by Eksper Metal Limited Şirketi. Any user who accesses, registers for, or uses the Portal is deemed to have accepted these Terms.

1. Scope of the Portal

The Portal is provided for obtaining information about products and services, submitting quotation requests, viewing proforma invoices, tracking orders and production processes, sharing documents, and communicating with Eksper Metal Limited Şirketi.

Eksper Metal Limited Şirketi reserves the right to modify, suspend, or terminate the scope, functions, and access conditions of the Portal without prior notice.

2. User Account

The user confirms that the name, surname, company, contact, and delivery information provided during registration is accurate, current, and complete.

A corporate user represents that they are authorized to conduct transactions and share information on behalf of the organization they represent.

Usernames, passwords, verification codes, and similar access credentials must be kept confidential.

Unless otherwise notified in writing, transactions made through an account are deemed to have been made by the account holder users.

The user must promptly notify Eksper Metal Limited Şirketi if they suspect unauthorized access or become aware of any circumstance affecting account security.

Eksper Metal Limited Şirketi reserves the right to review, restrict, suspend, or close accounts containing inaccurate, incomplete, misleading, or unverifiable information.

3. Quotation Requests

Quotation requests submitted through the Portal do not constitute an automatic order, price guarantee, or sales commitment by Eksper Metal Limited Şirketi.

The user is responsible for entering the product type, grade, dimensions, thickness, quantity, tolerances, standards, certificates, delivery location, and any other technical requirements accurately.

Eksper Metal Limited Şirketi may request additional information, documentation, or approval for incomplete, inconsistent, or technically unclear requests.

Suggestions, descriptions, product matches, and draft content generated with artificial intelligence support within the Portal are provided for informational purposes only. Final technical assessment is subject to the approval of an Eksper Metal Limited Şirketi representative.

The quotation validity period, delivery time, payment terms, shipping details, and other commercial conditions are separately specified in the quotation or proforma invoice.

4. Proforma and Orders

Unless otherwise stated in the relevant document, a proforma invoice displayed in the Portal is not a final invoice.

The proforma invoice may include product, quantity, price, currency, tax, delivery, payment, packaging, shipment, and other commercial terms.

An order becomes final only upon the written approval or order confirmation of Eksper Metal Limited Şirketi.

The user is responsible for reviewing the information in the proforma invoice or order confirmation. Any error or discrepancy must be reported in writing before order approval.

Stock availability, production capacity, raw material supply, logistics conditions, exchange-rate movements, and other commercial factors may affect prices, delivery times, and product availability.

Eksper Metal Limited Şirketi reserves the right to update prices, delivery periods, or technical conditions where necessary before order confirmation.

5. Order and Production Tracking

Order, production, quality-control, shipment, and delivery statuses displayed in the Portal are for informational purposes.

Estimated dates may change due to supply, production, quality control, customs, transportation, weather conditions, force majeure, or similar reasons.

Process information displayed in the Portal does not replace the terms set out in the written order confirmation or agreement.

Material changes to a process will be communicated to the user, where reasonably possible, through the Portal and/or registered communication channels.

6. User Obligations

The user agrees to:

  • Use the Portal in compliance with applicable law, principles of good faith, and these Terms.
  • Not share misleading, incomplete, unlawful, third-party, or rights-infringing information or documents.
  • Not attempt to compromise the security, infrastructure, or availability of the Portal.
  • Not gain unauthorized access, use another user's account, collect data, upload malicious software, or interfere with the operation of the Portal.
  • Not copy, reproduce, distribute, or republish Portal content for commercial purposes without the written permission of Eksper Metal Limited Şirketi.

7. Intellectual Property

Unless expressly stated otherwise, all designs, software, text, visuals, trademarks, logos, technical documents, catalogues, quotation templates, and other content available on the Portal belong to Eksper Metal Limited Şirketi or the relevant rights holders.

Such content may only be viewed within the intended use of the Portal. No transfer of intellectual-property rights or express license to use the content is granted to the user.

8. Privacy and Personal Data

Personal data shared while using the Portal is processed by Eksper Metal Limited Şirketi in accordance with applicable legislation and the Privacy Policy published on the Portal.

The user is responsible for keeping their contact, quotation, order, technical-requirement, and commercial-process information up to date. Details regarding personal-data processing are provided separately in the Privacy Policy.

9. Limitation of Liability

The Portal is provided on an “as is” basis. Eksper Metal Limited Şirketi does not guarantee that the Portal will operate uninterruptedly, error-free, or compatibly with every device and connection type.

Information, technical descriptions, suggestions, estimated timelines, or visuals in the Portal do not constitute binding technical commitments. The final terms are those stated in the written quotation, proforma invoice, order confirmation, or agreement.

To the extent permitted by applicable law, Eksper Metal Limited Şirketi shall not be liable for direct or indirect losses arising from incorrect information entered by the user, unauthorized access, interruptions in internet or third-party services, force majeure, or the user's breach of these Terms.

10. Suspension and Termination

Eksper Metal Limited Şirketi may temporarily or permanently suspend or close a user account if the user breaches these Terms, provides false or misleading information, compromises Portal security, engages in unlawful activity, or where legitimate commercial or security reasons exist.

Closing an account does not eliminate obligations arising from any prior order, payment, delivery, or contractual relationship between the user and Eksper Metal Limited Şirketi.

11. Changes to These Terms

Eksper Metal Limited Şirketi may update these Terms when necessary. The updated version becomes effective on the date it is published on the Portal.

Continued use of the Portal after such changes means that the user accepts the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye.

Courts and enforcement offices authorized under applicable legislation shall have jurisdiction over disputes arising from these Terms.
